Lawsuit History
The ongoing consumer class action lawsuit against Wellness Pet Food involves allegations of the company misrepresenting and failing to fully disclose the presence of harmful substances and chemicals in its pet food products. The company attempted to challenge the validity of the lawsuit by questioning the plaintiffs' standing to bring the claims. However, the judge ruled against Wellness, stating that the plaintiffs' claims were based on the assertion that they wouldn't have purchased the products if the harmful substances had been accurately disclosed.
The lawsuit focuses on specific Wellness pet food brands, including "Wellness CORE Adult Dry Ocean Whitefish, Herring Meal and Salmon Meal," "Wellness Complete Health Adult Dry Whitefish and Sweet Potato," and "Wellness Complete Health Adult Grain Free Whitefish and Menhaden Fish Meal." The plaintiffs conducted testing that revealed elevated levels of arsenic and lead in these pet foods.
Particular attention was given to the presence of arsenic, which can be absorbed by certain ingredients like rice and sweet potato during cooking, increasing potential exposure. The plaintiffs argue that Wellness wrongfully sold these contaminated products without adequate labeling or warnings about the presence of harmful toxins, which could accumulate over time and lead to pet poisoning, injury, or disease.
The plaintiffs further contend that Wellness' marketing campaigns and branding, including terms like "Uncompromising Nutrition" and "Unrivaled Quality Standards," contributed to the deceptive nature of the product representation. Additionally, the pet foods were found to contain significant levels of BPA, an industrial chemical known as an endocrine disruptor.
Overall, the lawsuit seeks to hold Wellness Pet Food accountable for allegedly misleading consumers about the safety and quality of their products and for failing to disclose the presence of harmful substances in their pet foods.
